Unlawful discrimination is where an employee is treated less favourably than another on the basis of what is known as a ‘protected characteristic’ namely:
- their race (including nationality)
- sex including pregnancy and maternity
- religion or belief
- sexual orientation
- marital status
- gender reassignment
