Debt recovery

Many debts will be paid if the debtor knows you have consulted a solicitor. We will help you to identify the problem and sort out the “can’t pay” from “won’t pay”. When we go to court, we expect to win the case and obtain judgement in your favour. This does not always mean you will be paid and we may have to take further action.

We will always tell you if we think there is no value in going to court because your debtor cannot pay or cannot be found. Also, it may be more economic for you to pursue your claim personally through the small claims court – we can help you with this.

Building disputes

Problems with a builder are the most common form of household dispute. Whilst established companies can make mistakes, ‘casual’ builders are the most frequent cause of complaint and claim. There is often little that can be done to bring a claim against a builder who operates from a mobile telephone and cannot be contacted but, the sooner you talk to us, the better placed we will be to help you.

Established and reputable builders are no different to any other business that has breached its contractual obligations. We will tell you where you stand legally and agree what you want to achieve. The involvement of a solicitor may be enough to get your building project back on track but it may require the threat of court action to bring him to the negotiating table. If this fails, we will seek compensation through the courts.

Other disputes

We handle all types of civil litigation work for our private and family clients. When problems arise, we will actively manage the resolution process because there is often more than one way to proceed. We will highlight the strengths and weaknesses of your position, and those of the other party as we see them, and then discuss the options available to you. Once we have explained the implications of each option, we will recommend a clear course of action.

Whilst our solicitors have a wealth of litigation experience, we prefer to avoid court action and look for a negotiated settlement – this is often quicker, less expensive and less likely to produce an unexpected result. However, if your essential interests are threatened, we will take court action without any hesitation.
